Neglect of right “to be forgotten” can cost to Russian search engines maximum 1 million roubles

Draft law about right “to be forgotten” passed second reading in state duma. Maximum penalties for search engines were reduced. Now it is planned to impose one million roubles penalty instead of originally planned three millions.

As mentioned RBC, under revised draft, search engine is not responsible if it does not comply with citizen’s requirement to cease show in search results links providing access to information about such citizen. The draft provides liability if search engines does not comply with requirement to cease show links, providing access to information about complaining citizen, mentioned in writ of execution within the term determined by the bailiff after decision to impose penalty for non-execution was issued. Search engines are also responsible if they continue to neglect requirements of bailiff.
