Right holders and search engines consider idea of self-regulation in fighting piracy in Russia

Russian major right holders – media companies producing and distributing audio-visual content – discussing the opportunity to delete links to web-sites with illegal video content from search results without court order or any court participation; such opportunity could be realized in the form of voluntary agreement or memorandum obligatory for all its participants.

Yandex is not going to give up in fight with right holders

Three Russian television channels have filed complaints against Yandex aiming to block illegal copies of four serials. All three complaints require Yandex to “cease creation of technical conditions causing providing of illegal copies of audiovisual works in question in search results”. The complaints also seek 10 thousands Roubles as compensation for infringement of exclusive rights. Yandex is not agreed with position of TV channels and intends to oppose requirement to block referrals to pirate copies in search results.

Russian cinemas asked the Russian authorities to forget about the quotas for movies

Recently Russian ministry of culture (MinCult) proposed to set up quotas for screening of movies in cinemas in Russia. Not more than 35% of all screenings for one movie, except the national one, i.e. produced in Russia. This proposal aimed to “support fair competition in Russian market” and provide equal screening opportunities for all movies.

Russian ministry of culture considers another restriction of distribution for foreign movies

Russian ministry of culture (MinCult) has published amendments to the law on cinema. These amendments one more time confirm the special relation attitude of MinCult to the foreign movies, especially to Hollywood movies. Perhaps because the people prefer Hollywood movies which are demonstrated in Russian cinemas more often than Russian movies?

Major Russian media companies have taken off their online broadcasting from main Yandex’s main page

A few major Russian media companies – Gazprom Media, National Media Group and The First Channel – have taken off their online broadcastings from main page of Russian search engine Yandex’s due to piracy accusations. Media companies not alone in their concerns. Not so long time ago right holders in entertainment content have accused Yandex of piracy.

SWD IA on EU copyright modernisation – impacts of baseline option for use of protected content in digital and cross-border teaching activities

The legal uncertainty faced by educational establishments and teachers in certain MS for digital uses is expected to persist under the baseline option. Only reforms at national level or developments in the licensing market could contribute to reduce it. A certain number of MS (e.g. ES, UK) have recently amended their legislation to clarify that the teaching exception applies to content used in secure electronic environments.

Russian legislators have amended the law on film festivals

Russian state duma has adopted in third reading amendments to Russian law on cinematography. These amendments can enter into force already this autumn. New law defines what cinema festival is – it is event with no more than 10-days contest program, the film can be demonstrated no more than twice, and the quality of such film it be assessed by the jury.

When the parallel import is a constitutional matter

Russian constitutional court has prohibited application of the similar sanctions for parallel import and for selling of counterfeits.  One Russian company PAG has concluded state contract for supply to medical institution a special paper under Sony mark for ultrasound scan. Such paper Russian company has acquired from Poland company and imported to Russia. The customs has seized the paper under the order of commercial court of Kaliningrad province.
