Draft third edition of USA copyright office compendium – the copyrightability of a derivative work

A derivative work may be registered with the U.S. Copyright Office, provided that it constitutes copyrightable subject matter. Derivative works are a subset of the subject matter categories, rather than a separate and distinct category of work. In other words, the new material that the author contributed to the derivative work must fall “within one or more of the categories listed in section 102 of the Copyright Act.”

How new law regulates blocking of web-site mirrors in Russia?

In order to trigger the mechanism of blocking, the Russian Roskomnadzor has to receive a court order. After that, Roskomnadzor requires internet service providers (ISP) to restrict access to web-site in Internet permanently, if there was illegally placed information containing objects of copyright or information necessary to receive such objects with help of info-telecommunication networks, including Internet.

Assessment of draft law on mirrors of pirated web-sites in Russia after first reading

First assessment states that the law intended to prevent illegal dissemination and exploitation of intellectual property objects in Internet network. The committee on culture of Russian state duma, the “author” of this assessment, upheld conception of the draft law, but has its own comments.

New order provides criteria to determine whether information is to be blocked in Internet in Russia

This “collective order” has been issued by Russian ministry of internal affairs, Russian Federal Taxation Service, Russian Roskomnadzor and Russian Federal service on protection of customers’ rights. This order is very interesting. It provides criteria under which it is possible to determine whether information is to be forbidden for dissemination in Russian segment of Internet.

Russian minister of culture proposed to block mirrors of web-sites without court order

Actually Russian Ministry of Culture (MinCult) believes responsibility for pirating of content must be more rigorous and unyielding than provided in recently proposed draft law on blocking of mirror web-sites. Chief of MinCult, Vladimir Medinsky, believes there should be provided a fine for user, who downloads pirated content.

How the problem with mirrors of pirate web-sites can be resolved in Russia

Last year right holders have achieved permanent blocking of Rutracker.org site for copyright infringement. But the result – permanent blocking – was not enough for them. Clones of Rutracker appeared in spite of right holders. In order to shut down Rutracker’s “family” it was necessary to start all over again.

The Russian council of the federation considers options for blocking of broadcasting in Russia by foreign mass media, if such media have audience in Russia. How should be defined “audience” and how to count such audience is not clear and it is not clear whether it is possible to make correctly at all.

Russian Roskomnadzor very carefully monitors pirated copies of “The Putin Interviews” in Internet

Russian Roskomnadzor requested more than 100 web-sites to restrict access to illegal copies of “The Putin Interview” by Oliver Stone. The exclusive rights in “Interview” have been acquired by Russian First Channel for Russian territory.
