Not only Russian copyright, broadcast and digital law
The Russian rulings provide the Russian ministry of culture with right to change the date of release for foreign movie if the Russian movie is to be also released on the same dates. So most often the Hollywood movies fall under these rules. That is what happened with cartoon “The Queen’s Corgi”, but the outcome was unexpected.

The traditional mass media in Russia – traditional television and radio stations and print issues – are totally under control of the state. Most of them have also strong support from the state budget. But if these media provide information for huge massive audience, should they be liable for mistakes, i.e. for so called fake news made by mistake, omission or by any other reason. In other words, if traditional mass media provides incorrect information should it be liable?

In Russia there is a law prohibiting the dissemination of explicit content in internet. The liability for violation of such law should bear also the owner of mass media or operator of web-site where the content is published or through with the explicit content is disseminated. The Russian online media resource Vedomosti has been fined for dissemination of explicit content despite the fact that there was warning and the content in question has been available on twitter through the link.

The ministry of culture is famous of its legislative proposals like restriction of access to web-sites without court order. The minister is pretty sure that all anonymity will disappear from global internet and go to darknet, but underlined that it is his own opinion. But many professionals in Russia know that very often personal opinions of Russian official persons can become reality under the law.

The Russian constitutional court decided to amend the law on mass media. The law provides property restriction for foreign citizens and overseas entities. Under the law the person with foreign citizenship (even if the second citizenship is Russian) or legal entity, incorporated outside of Russia or directly/indirectly owned by the overseas entity (more than 20%), can own or control not more than 20% of Russian mass media. Such provision of law restricts the property right in order to “protect national security” claimed legislators.

But it still can be adopted. The law aims to forbid persons to insult Russian authorities in internet; otherwise the person can face fine up to 5 thousands Roubles or even can be arrested for 15 days. The Russian ministry of communication does not support the draft law. The deputy of the minister has said “the one of the duties of Russian authorities is listening the criticism of their work calmly. They are not so impressionable.”

Recently audiovisual right holders have signed antipiracy memorandum with Russian search and IT companies like Yandex but without participation of Google. The main goal of this memo is de-indexing links to pirate web-resources without court order and elimination of all such links from search results. Russian search engines have signed this memo, but without enthusiasm. Book publishers and right holders also want to sign similar memo, because IT counterparts of memo underlined that the memo covers only audiovisual works.

Online distribution of audio-visual content in Russia plays prominent and leading role in Russian internal market. The right holders take online distribution very seriously because it makes money even when the movie is not shown in cinemas. Anyway, the right holders are not happy with statistics provided by the online cinemas. On the basis of this statistics the cinemas calculate royalties and pay them to right holders. Right holders want statistics from the third party.

Russian authorities decided to protect the purity of morals in Russian internet and clear out “all negative words” of insulting character, but only in relation to Russian authorities. In other words mass media, bloggers and any person can write in internet anything negative about any authorities except Russian in Russian segment of internet. In other words if you write something negative about Russian politician you could be punished in Russia under proposed law.

The law on restrictions for news aggregators in Russia has passed first reading in Russian state duma. The amendments are to be made till the end of this year. The Russian IT company Yandex, operator and owner of service Yandex.News, and Russian ministry of communication (MinCom) did not like the draft law. Both believe the law provides excessive regulation.
