Users of this social network like Vkontakte because you can get satisfaction for your taste in music, video or even books. But in most cases right holders failed because Vkontakte\u2019s position is always the same \u2013 \u201cwe are only informational intermediary\u201d, therefore \u201cwe are not liable if the user posts or links to any illegal content\u201d, \u201cwe can only takedown such content in our network\u201d.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><!--more--><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Recently VKontakte has been sued for copyright infringement by major Russian book publisher Eksmo. The lawsuit concerns copies of audiobook available in Vkontakte. But now claimant does not seek restriction of access to social network (under the Russian law the claimant has the right to require it as preliminary measure), the claimant wants to \u201cpunish Vkontakte by Rouble\u201d, and in other words it seeks to impose the fine on social network. The lawsuit has been <a href=\"https:\/\/www.mos-gorsud.ru\/mgs\/services\/cases\/claim-civil\/details\/c6834fd3-3b8b-42f2-b84d-5dd2c49c09b7?participants=\u0432+\u043a\u043e\u043d\u0442\u0430\u043a\u0442\u0435&amp;caseRangeDateFrom=01.03.2019&amp;caseRangeDateTo=26.04.2019&amp;formType=fullForm\" rel=\"nofollow noopener\" target=\"_blank\">filed<\/a> to Moscow town court and the court has ruled to apply preliminary measures.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The court has obliged Russian internet watchdog Roskomnadzor to \u201ccease creating technical conditions enabling dissemination\u201d of audiobooks at issue. As long as Vkontakte use https protocol, the Roskomnadzor should block entire social network because there is no technical opportunity to block certain web-page in social network. But after some time the social network has express hope that it could be possible to settle the lawsuit and the publishing house express its opinion that the social network would delete the audiobooks in at issue.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The social network has proposed the publishing house to settle the lawsuit at the trial. But social network failed to comply with court order prescribing to delete the audiobook at issue.
