Axel Voss’s amendments to Copyright DSM on 12 September

The increasing imbalance between powerful platforms and press publishers, which can also be news agencies, has already led to a remarkable regression of the media landscape on a regional level. In the transition from print to digital, publishers and news agencies of press publications are facing problems in licensing the online use of their publications and recouping their investments. In the absence of recognition of publishers of press publications as right holders, licensing and enforcement in the digital environment is often complex and inefficient.

Option 2 would bring a high degree of legal certainty to educational establishments and teachers across all MS. This could lead in the short term to an increased use of illustrative resources and an enriched learning environment for students. The actual impacts on education institutions would vary between MS, depending on how the optional teaching exception has been implemented so far and on the licensing mechanisms in place.

The paradox of Russian law system – the law is in force but impossible to be implemented

One famous Russian writer once has said: the rigor of the Russian law is diminished by their disregard. It should be added at the end “at all levels”. In 2017 in Russia it has been adopted a law on online video services. It is very rigorous. For example, if Netflix would like to operate in Russia it has to receive governmental approval. But the situation is not simple for Russian legal system and very lucky for Netflix, YouTube and similar services.

Russian TV channels asked the court to block Yandex for copyright infringement

Russian TV channels, belonging to major Russian media holding Gazprom Media, have applied to Moscow court for preliminary measures in relation to Russian search engine Yandex for copyright infringement. The court sided with applicants and notified Russian internet watchdog Roskomnadzor thereof.

Russian Central Bank wants to expand the scope of its right to block web-sites in Russia

A new draft law is developing in order to provide the Russian Central Bank with authority to restrict access to certain web-sites in Russian without court order. The draft law is targeted at web-sites used for financial fraud. For Russian financial regulator it is irrelevant whether web-site is hosted or operated in Russia or overseas. Currently the draft law passes the interdepartmental consideration and the final version should be agreed near future.

Major Russian media companies have taken off their online broadcasting from main Yandex’s main page

A few major Russian media companies – Gazprom Media, National Media Group and The First Channel – have taken off their online broadcastings from main page of Russian search engine Yandex’s due to piracy accusations. Media companies not alone in their concerns. Not so long time ago right holders in entertainment content have accused Yandex of piracy.

Almost 14-years old EU parliament position on recommendation for film heritage

This recommendation aims at fostering better exploitation of the industrial and cultural potential of European film heritage by encouraging policies of innovation, research and technological development in the field of conservation and restoration of cinematographic works. The hereinafter recommended actions aim to ensure that the conditions necessary for the competitiveness of the Community’s film industry exist and accelerate the development of its competitiveness.

Russian ministry of economy disliked the rules drafted for implementation of Yarovaya law

Yarovaya law is significant burden for Russian telecommunication companies. Under this law they are obliged to keep a lot of information, including communication between their subscribers. There is the law – so called Yarovaya law, but there are no rules, implementing this law. The Russian companies are in very strange position – they have to comply with Yarovaya law, but they can’t do this – there are no rules, prescribing how to do it under the law.
