“Registration” of a copyright occurs when the Register of Copyrights registers the claim

Whether registration occurs when an owner files an application to register the copyright or when the Register of Copyrights registers the copyright? Fourth Estate Public Benefit Corporation filed a suit for infringement against Wall-Street.com and Jerrold Burden. The complaint alleged that Fourth Estate had filed an application to register its allegedly infringed copyrights, but that the Copyright Office had not registered its claims. The district court dismissed the action because Fourth Estate failed to plead compliance with the registration requirement.

Russian Central Bank and Ministry of internal affairs have upheld the proposed law on VPN and similar services

The new law, proposed recently, provides pretty harsh regulation for VPN and anonymizer services operating in Russia. Not all are happy with intention of Russian government to control anonymizers and messengers in Russia. Internet ombudsman believes it is madness to block VPN services in a case if they don’t comply with requirements of Russian supervising authorities.

It was proposed to repeal the “law on bloggers” in Russia

New draft law, repealing the law on bloggers in Russia, has been introduced to Russian State Duma. Provisions of the law on bloggers, regulating dissemination of publicly accessible information in Internet by bloggers, have been declared as ineffective. Many believes that registry of bloggers, created under this law, is a stupid and absurd thing.

Russian legislators proposed to forbid VPN and similar services in Russia

New draft law proposes amendments to Russian law on information, its protection and informational technologies. Explanatory note to this draft underlines that relevant Russian authorities face obstacles when forbid dissemination of illegal information under current Russian law. First of all it is impossible to oblige search engines to exclude links to forbidden information in search results. Secondly VPN services nullify all endeavours targeted to control over dissemination of information in violation of Russian law.

How OTT-services, operating in Russia, will count viewers for regulation purposes?

Russian Roskomnadzor proposed instructions for OTT-(audio-visual)-services explaining how to count viewers visiting web-sites of such services. This instruction has been proposed in order to implement new law on OTT-(audio-visual)-services operating in Russia. This law provides regulation for popular services with audience more than 100 thousands viewers a day.
