Draft evaluation and review of the IPR enforcement directive – quo vadis?

In the Digital Single Market and the Single Market Strategies the Commission announced that it will review the EU intellectual property enforcement framework. In response to this announcement DG GROW evaluated the functioning of Directive 2004/48/EC on the enforcement of intellectual property rights and prepared a review of the Directive. Recent discussions between the relevant Cabinets and services involved revealed a fundamental disagreement on the general orientation of the initiative.

Australian copyright law review – alternative to fair use exception, specific exceptions and orphan works

An alternative exception, should fair use not be enacted, is also recommended: a ‘new fair dealing’ exception that consolidates the existing fair dealing exceptions and provides that fair dealings for certain new purposes do not infringe copyright.

Russian TV channel Match TV sued web-resource Sports.ru for copyright infringement

According to suit, Match TV believes web-resource illegally demonstrates highlights of two matches FNL, as it is stated on sports.ru’s web-site. Match TV claims it spends a lot of money in order to acquire rights in content from official right holders. First court hearing will be 30th of May.

Amendments to proposed regulation to fulfil obligations under Marrakesh Treaty by EU

This Regulation should ensure that, in accordance with Article 9 of the Marrakesh Treaty, the contracting parties provide financial and human resources to facilitate international cooperation between authorised entities, the adequate availability of accessible format copies and the cross-border exchange of such copies.

Russian president’s counselor on internet doubts to accuracy of data on Russia contained in 2017 Special 301 Report

German Klimenko, Russian president’s counselor on internet, does not believe that data, containing in 2017 Special 301 Report and describing the level of piracy in Russia, are correct. The finding that piracy in Russia has increased on 300% does not reflect reality.

Proposal for regulation on the exercise of copyright and related rights for online transmissions of broadcasting in EU – what it’s all about

The ancillary online services covered by this Regulation are those services offered by broadcasting organisations which have a clear and subordinate relationship to the broadcast. They include services giving access to television and radio programmes in a linear manner simultaneously to the broadcast and services giving access, within a defined time period after the broadcast, to television and radio programmes which have been previously broadcast by the broadcasting organisation (so-called catch-up services).

Australian copyright law review – with a fair use exception the right questions could be asked

An Australian copyright law review committee recommended the introduction of fair use in 1998. Almost 30 existing exceptions could be repealed, if fair use were enacted. In time, others might also be repealed. Replacing so many exceptions with a single fairness exception will make the Copyright Act considerably more clear, coherent and principled.
