Russian minister of culture has requested Russian government to regain copyright in Russian films to “Lenfilm” and Gorky film studios

Russian minister of culture Vladimir Medinsky has sent a letter to Russian prime-minister Dmitry Medvedev. In this letter Medinsky requested Medvedev to regain lost copyright in movies made by Lenfilm and Gorky Film studios to these studios. Such measure could help these studios to earn at least 200 million roubles in a year, Medinsky believes.

Actually there are two proposal and both are different. Let’s take a look at the first of them. The draft law proposed certain amendments to regulation of collective rights management. These amendments concern collecting societies received state accreditation. First of all under new proposal such CMO must be non-profit organisation.

JASRAC’s public comment on collective management rules review

The Law on Management Business of Copyright and Neighboring Rights (hereafter referred to as “the Management Business Law”) was enacted in 2001. JASRAC was registered as a management business operator under the Management Business Law, and continued its collective management business. Since other management business operators for music copyrights were also registered, a multiple-СMO environment emerged in the field of music copyright administration in Japan.

Russian online cinemas must be controlled by Russians as believes Russian media communication union

Russian media-communication union, consisting of major communication operators and media holding companies, has proposed to reduce foreign participation in companies operating or owning online cinemas in Russia, like Ivi, Okko or Megogo. The idea is that foreign persons can own not more than 20% of company’s shares.

BMI’s victory over DOJ’s rule of 100% licencing

BMI promptly sought a declaratory judgment that the Consent Decree does not require 100% (“full-work”) licensing. Nothing in the Consent Decree gives support to the Division’s views. If a fractionally-licensed composition is disqualified from inclusion in BMI’s repertory, it is not for violation of any provision of the Consent Decree.

S.I.A.E.’s public comment on collective management rules review

Right holders should be permitted to grant ASCAP and BMI rights other than those of public performances. The right holders will be allowed to confer the administration of their repertoires to the same Collecting Society for both performing and mechanical rights, and consequently the Collecting Society will be able to provide users with a “one-stop shop”, thus facilitating their job.

Russian Ministry of culture has formed board of experts who should impact on films release and their distribution

The release dates of new films in Russia will depend on new board of experts created by Russian ministry of culture (MinCult). This board has also authority to decide whether to grant a permission to distribute a film in cinemas or repeal such permission. One of the members, included in such board, dislikes such idea.
