Self-standing obligation of measures

Over the last years, the functioning of the online content marketplace has gained in complexity. Online services storing and providing access to copyright protected content uploaded by their users have flourished and have become main sources of access to content online. When the content is uploaded by users who do not own the relevant rights in the whole or parts of the content they upload, this situation affects rightholders’ possibilities to determine whether and under which conditions their content is used as well as their possibilities to get an appropriate remuneration for it. It is therefore necessary to provide for certain measures that these service providers should take to protect the content.

It is necessary to define the concept of press publication in a way that embraces only journalistic publications, published in any media, including on paper, in the context of an economic activity which constitutes a provision of services under EU law. The press publications to be covered are those whose purpose is to inform the general public and which are periodically or regularly updated.

Russian Kremlin endorsed repeal of criminal penalties for reposts in internet

Russian deputies proposed to abolish criminal liability for reposts or sharing of extremist publications or materials in World Wide Web. Some people just make reposts of information published mostly in social networks and as a consequence bear criminal liability because technically under current Russian law it is dissemination of prohibited information. Russian Kremlin upheld this idea.

Now search engines are not allowed to search prohibited information in Russian segment of internet

The new law has been signed by Russian president. Under new law if search engine fails to connect to the federal data bases, containing the list of web-sites which is blocked in Russia, the search engine is to be imposed a penalty. In a case of natural person the penalty is up to 5 thousands Roubles, and in a case of legal entity the penalty is up to 700 thousands Roubles.

Supreme Court made involvement of person, whose web-site can be blocked, mandatory in consideration of case

Current law provides special list of information prohibited for dissemination in Russia. If such information is disseminated through the web-site, the access to such web-site can be restricted and even if the owner or operator of such web-site is not aware thereof. So the owner or operator of web-site can face just notification that the access to his web-site is restricted in Russia. Such practice of web-sites blocking is common in Russia.

SWD IA on EU copyright modernisation – impacts of second option for out-of-commerce works in the collections of cultural heritage institutions

EU legislative intervention (i) requiring MS to put in place legal mechanisms to facilitate collective licensing agreements for all types of OoC works and to foster national stakeholder frameworks, and (ii) giving cross-border effect to such legal mechanisms.

Under Option 2, the presence of legal frameworks everywhere in the EU that allow for licences issued by CMOs to also cover the rights of outsiders would give CHIs the possibility to see their related transaction costs diminish considerably everywhere in the EU for the digitisation and dissemination of works. This would apply to all types of works. Under this option, it would be possible for the CHI to reduce that cost to the one of negotiating a single licence with a CMO. Licences concluded on the basis of such legal frameworks could have cross-border effect for all works too.

Right holders asked “Russian Google” Yandex to de-index links to pirate web-sites

Producers and distributors of content have called Yandex CEO Arkady Volozh to de-index URLs of web-sites with illegal content, in other words they asked him not to search such web-sites in internet. They have sent him a collective letter signed by representatives from music industry, internet industry, from association of movie and TV producers and media-communication union.

Russian sport radio station has been sued for coverage Pyeongchang 2018

Russian company “Telesport” has filed a suit against Russian radio station for infringement of broadcasting rights. According to suit “Telesport” has concluded with International Olympic Committee agreement allowing broadcasting the sport events in Pyeongchang 2018 on exclusive basis. “Telesport” seeks 33 mln Roubles for damages.

Russian software developer filed 44-mln suit against Amazon and Veeam for copyright infringement

Software developer from Saint-Petersburg has filed a suit against Amazon and Veeam Software. The claimant seeks almost 44 mln Roubles for damages. Formerly claimant worked in Veeam’s Russian entity – “Intervim”. According to claim the claimant developed software “eLearning Metadata Manager” targeted to developers of content for online courses. In 2016 he quit and proposed his employer to conclude non-exclusive license agreement in order to allow employer to use developed software.
