Russian investigative committee has initiated criminal case for manufacturing and distribution of counterfeited mineral water “Essentuki” by organised group of persons suspected in committing a crime under article 180 of Russian criminal code for illicit use of means of individualization. This is the first criminal case for counterfeiting in such category of goods.

After duly research the Russian ministry of trade and industry has names the most popular category of counterfeits in Russia – the products of light industry. 20% of almost all products of this industry are counterfeited; the monetary assessment counts up to 725 billion Roubles in 2017.

Russian internet watchdog – Roskomandzor – prepares negative assessment of Russian draft law on big data. The draft law introduces amendments to Russian law on information, its protection and informational technologies aiming to regulate users’ data.

By its three questions (1, 2, 3), which should be examined together, the referring court asks, in essence, whether, and in what possible circumstances, the fact of posting, on a website, a hyperlink to protected works, freely available on another website without the consent of the copyright holder, constitutes a ‘communication to the public’ within the meaning of Article 3(1) of Directive 2001/29.

The Russian association on copyright protection, working in interests of Russian book publishers, has proposed Yandex to sign antipiracy memorandum similar with those signed with audiovisual right holders but for digital and audio books. The association has also notified Roskomandzor thereof.

The Russian agenda on digitization also provides digitization of broadcasting and it was intended to cease analogue broadcasting to Russian households already in January 2019. But the fact that many households can stay without opportunity to receive new signal has changed the plans of Russian government. Company Societe Jas Hennessy et Compagnie has chosen to sue bootleggers for trademark infringement and sought 5 mln Roubles as compensation. The group of four persons from Russian town Voronezh has manufactured alcohol under famous brands. The court accepted the lawsuit and will consider it.

Deputy of Roskomandzor’s CEO Vladimir Subbotin has met with Google’s representative. They discussed how Google comply with current Russian law. The most important issue was Google’s compliance with obligation to filter illegal information in searching.

Similar positive impact on researchers as under Option 2 as regards both legal certainty and reduction of transaction costs, as a result of the introduction of an exception harmonised at EU level. Additional positive impact as this option would remove the legal uncertainty and the grey area as regards the research projects carried out by public organisations with a possible commercial outcome, including in cooperation of these organisations with private partners (PPPs).

A copyright claim in music or lyrics may be registered with the U.S. Copyright Office in the same manner as other works of the performing arts. When submitting an online application, the applicant should select “Work of the Performing Arts” as the Type of Work.
