SWD Impact assessment on the modernisation of EU copyright rules – the general objective

The Internet has favoured the entry of new market players and the development of new services (e.g. music streaming services, Video on Demand – VoD – platforms, etc.) providing access to a large quantity and variety of content online. Digital technologies also offer new opportunities to cultural heritage institutions (CHIs) willing to digitise and disseminate parts of their collections that would otherwise remain confined to their premises with limited access to the public.

Public comment on collective rights management rules review by National Association of Broadcasters

NAB members are both creators and users of copyrighted works and, as such, recognize the important need to balance the rights of copyright owners against the public interest. The blanket licensing of performance rights is inherently anti-competitive because the very nature of the PRO’s blanket license involves the fixing of a single price for all music, irrespective of which songs are actually used.

Proposal for regulation on the exercise of copyright and related rights for online transmissions of broadcasting in EU – rights issue

Through the principle of contractual freedom it will be possible to continue limiting the exploitation of the rights affected by the principle of country of origin laid down in this Regulation, especially as far as certain technical means of transmission or certain language versions are concerned, provided that any such limitations of the exploitation of those rights are in compliance with Union law.

Proposal for regulation on the exercise of copyright and related rights for online transmissions of broadcasting in EU – ancillary online services

The ancillary online services covered by this Regulation (official document) are those services offered by broadcasting organisations which have a clear and subordinate relationship to the broadcast. They include services giving access to television and radio programmes in a linear manner simultaneously to the broadcast and services giving access, within a defined time period after the broadcast, to television and radio programmes which have been previously broadcast by the broadcasting organisation (so-called catch-up services).

Russian senators consider idea to block foreign mass media in Russia

The Russian council of the federation considers options for blocking of broadcasting in Russia by foreign mass media, if such media have audience in Russia. How should be defined “audience” and how to count such audience is not clear and it is not clear whether it is possible to make correctly at all.

Russian Roskomnadzor very carefully monitors pirated copies of “The Putin Interviews” in Internet

Russian Roskomnadzor requested more than 100 web-sites to restrict access to illegal copies of “The Putin Interview” by Oliver Stone. The exclusive rights in “Interview” have been acquired by Russian First Channel for Russian territory.

Russian TV channel Match TV sued web-resource Sports.ru for copyright infringement

According to suit, Match TV believes web-resource illegally demonstrates highlights of two matches FNL, as it is stated on sports.ru’s web-site. Match TV claims it spends a lot of money in order to acquire rights in content from official right holders. First court hearing will be 30th of May.

Broadcasters and retransmission service providers are increasingly investing in the development of digital and online services for the distribution of radio and television programmes. The online offerings of broadcasters include notably simulcasting services (TV/radio channels which are transmitted online alongside traditional broadcasting by satellite, cable or, terrestrial), TV catch-up services and podcasts.
