Option 3 – Application of country of origin to the clearing of rights for the services covered by Option 2 and for TV and radio-like linear online transmissions (and services ancillary to such transmissions)

This option would cover, in addition to the services covered under Option 2, TV and radio-like linear online transmissions which are not linked to a broadcast but are online only transmissions (webcasting) and services ancillary to the webcast (such as catch-up and previews of the webcasts). The “country of origin” (CoO) rule would apply to such services.

Application of country of origin to the clearing of rights for broadcasters’ online services ancillary to their initial broadcast

Introduce a rule providing that as concerns the licensing of rights for certain online transmissions by broadcasting organisations, the copyright relevant act takes place solely in the MS where the broadcasting organisation is established. As a result, in order to provide certain services in the Union, rights would only need to be cleared for the “country of origin” (CoO) of the broadcasting organisation (and not for the countries of reception).

Russian TV companies have reached agreement in order to guard their positions in market

Chiefs of Russian television companies – Russian First channel, All Russian tele-radio-broadcasting company, GasProm Media, STS media and National Media Group – have reached preliminary arrangement at the meeting. Russian TV companies want to protect brands and keep exclusive in popular TV shows without buyout of rights in content.

SWD Impact assessment on the modernisation of EU copyright rules – options to achieve the objectives: baseline and option 1

It were assessed the baseline scenario, one non-legislative and two legislative options to facilitate licensing in order to enhance cross-border transmissions of TV and radio programmes online. The considered options are enabling options aiming to facilitate licensing of rights, in order to allow the market to respond gradually to legal and policy changes.

When the court sets the royalty rate, applied to the user of collective management organisation, lower than requested by CMO, does it infringe CMO’s property rights?

The CMO, SIA AKKA/LAA, complained to the European Court of Human Rights that the domestic courts had restricted the copyright of authors whose musical works were collectively managed by the CMO. They complained, in particular, that as a result of the domestic proceedings in which the domestic courts had ordered the CMO to conclude licence agreements with broadcasting organisations and had set a royalty rate, the authors’ exclusive rights to freely conclude licence agreements for the use of their musical works had been restricted, contrary to Article 1 of protocol No. 1of the Convention of Human Rights.

Russian ministry of culture proposed to repeal permission to distribute movies made for TV

Russian Ministry of Culture (MinCult) has proposed amendments to law on “State support of Russian cinematography”. These amendments repeal permission necessary for distribution of movies in Russian internal market if movies in question have been produced for TV broadcasting. Owners of internet cinemas have a hope that these amendments would also cover online distribution.
