Russian Federal Antitrust Service finally decided what monopoly is in Russian internet

Russian Federal Antitrust Service (FAS) develops fifth set of laws for antitrust regulation in digital markets. FAS has determined what is monopoly in Russian internet – in order to be considered as monopoly the market share of “interchangeable services” must be more than 35%. But there is still no clarity what is market of “interchangeable services”.

Different types of services can fall under the definition of “interchangeable services”. But it is not online markets. The owner of online platform can’t be considered as monopoly if the year revenue from such platform is less than 400 mln Roubles. Industry stakeholders are not sure who falls under new definition because the criterion for it is still discussed. The provision on intellectual property still remains in this fifth set of laws.
