Not only Russian copyright, broadcast and digital law
Russian internet watchdog Roskomnadzor (RKN) has decided to transpose the British approach to mass media regulation into Russia. Such decision has been made on reciprocal principle. The new supposed regulation is to be applied only to foreign mass media; the Russian mass media should be regulated as usual. UK regulator Ofcom has imposed on Russia Today because it believes RT has violated the principle of objectivity.

Publishers are increasingly facing difficulties in relation to the digital exploitation of, and the enforcement of rights in, press publications such as newspapers and magazines. The changes to the way copyright-protected content is distributed and consumed in the digital environment have affected press publications in a specific way. The publishing industry is in the middle of a shift from print to digital.

Publicly available channels are to be distributed through so called “one window” in internet according to the new recently proposed draft law. Other web-sites, which don’t participate in “one window scheme”, are to be blocked. There is already the candidate to be such “one window” operator. The draft law aims to create the single system of legal distribution for 20 publicly available channels. This system should be launched from 2020.

One deputy from Russian State Duma has proposed to delete account in social network if it was inactive during one year. The deputy believes if the account owner has died his account and page in social network is to be deleted. So, how to define whether holder of account is still alive – he should post something during the year. If the account – as well as its holder – is silent that means its holder is dead. Simple logic, but implementation of this idea is impossible.

Russian Ministry of Culture (MinCult) has proposed to track each film view in online cinema in special system (single federal informational automatic system of data on films demonstrations in cinema spaces). According to MinCult’s idea online cinemas have to connect to this system and provide it with data required and at their own account. Certainly online cinemas don’t like this idea.

Major Russian right holders, holding rights in audio-visual works, and Yandex have signed anti-piracy memorandum, the agreement aiming to delete links or pirate web-sites from search results. In order to execute this memo Yandex have developed its own bot – special software searching for illegal sources of right holders’ content. The bot is not only means of memo execution, but the main, and right holders, who signed this memo, are dissatisfied on its work.

They proposed it to improve distribution of their content in internet; actually they want make money on this distribution and don’t want lose financial opportunities. The operators, who currently don’t pay for distribution of such content, don’t like such proposal – it could cost them significantly.

No policy intervention. This option would rely on the voluntary deployment of technologies by user uploaded content services, which will continue to apply their own terms and level of transparency as to the functioning of the technologies.

Human rights council under the Russian president Vladimir Putin also does not like the new laws on fake news and insulting of Russian official authorities. The council asked the Putin to reject the law, but it asked to improve these laws. According to the council the law “unproportionally restricts the right on freedom of expression”. The liability, provided for dissemination of fake news, is excessive council believes.
