The counterfeiting is a serious and widespread problem in Russia

Research by BrandMonitor, a company specializing in brand and trademark protection, indicated that two thirds of counterfeit sellers admit selling fakes. Moreover, 46% of those who admit selling fake goods assume they were not breaking the law. The fact that counterfeits can be a hazard for consumers’ health or safety is not a priority for merchandisers or even for consumers themselves. According to merchandisers, counterfeits is more attractive to consumers because of lower price.

New law on copyright co-ownership has been proposed in Russia

The new proposed draft law aims to make clear the questions caused by the multiple copyright ownership in IP object. According to current Russian law the execution of exclusive right in IP object is carrying out by more than two right holders jointly. Explanation note states that under the Russian law all right holders must reach common agreement in relation to exploitation of their IP.

Russian book publishers also want to sign antipiracy memorandum with internet companies

The chief of Russian book union asked the chief of Roskomandzor – the Russian internet watchdog – to assist in signing of antipiracy memorandum between book publishers and internet companies in order to fight piracy more effective. The antipiracy memo, signed between right holders and internet companies, covers only strict circle of right holders and only audio-visual works, the books and other types of copyrighted content are not included in memo.

The sale of affiliated companies can trigger conflict linked to “common” brand

Two Russian insurance companies fight in court because their trade names are very similar. The trade name of one company is “RusStateInsure” (abbreviated RSI) and the trade name of second company is so far “RSI life”. RusStateInsure has file a lawsuit against RSI life for trademark infringement and despite the decision of RSI to change its tradename, the RusStateInsure does not intends to withdraw the lawsuit.

Mandatory exception covering text and data mining for non-commercial scientific research purposes

Legislative intervention introducing a harmonised exception would increase legal certainty and reduce rights clearance costs. Researchers would be able to mine scientific publications subscribed to by their institution in full legal certainty as long as this is done for non-commercial scientific research. In addition, transaction costs for public interest research organisations could be considerably reduced.

Third edition of USA copyright office compendium – Identifying the author of musical work

The author of a musical work (including any lyrics) is the creator of the music (and/or lyrics), not the person who merely transcribes the work. Transcribing or fixing a musical work in and of itself does not constitute authorship. Creating a recording of a musical work is not a form of musical work authorship in and of itself, although it may be a form of sound recording authorship if it contains sufficient creativity to constitute a copyrightable sound recording.

Russian book publishers also endeavor to clear search results from pirate links

But they make efforts only in relation to Russian search engine and internet company Yandex. Google and other search engines are out of their interest. There are also search engines of Mail.ru and Rambler company. The association, representing the copyright interests of Russian major book publishers, has filed lawsuit against Yandex seeking to clear the search indexing from links to pirate web-sites.

The producers and syndicators of programming obtain and license to the stations with which they contract all of the copyright and other rights necessary to broadcast the programming (including those for creative inputs such as a script, choreography, acting and directing), with the sole exception of the non-dramatic public performance rights to the copyrighted music therein.

Russian audio-visual right holders and internet companies have signed anti-piracy memorandum

Russian major internet companies Yandex, Mail.ru, Rambler and RuTube together with Russian major audio-visual right holders Gazprom Media, National Media Group, First Channel, VGTRK, STS Media, association Internet Video and Association of movie and television producers have signed anti-piracy memorandum. This memorandum has been signed at the meeting hosted by Russian internet watchdog Roskomandzor.
