Over the last years, the functioning of the online content marketplace has gained in complexity. Online services storing and providing access to copyright protected content uploaded by their users have flourished and have become main sources of access to content online. When the content is uploaded by users who do not own the relevant rights in the whole or parts of the content they upload, this situation affects rightholders’ possibilities to determine whether and under which conditions their content is used as well as their possibilities to get an appropriate remuneration for it. It is therefore necessary to provide for certain measures that these service providers should take to protect the content.

Now search engines are not allowed to search prohibited information in Russian segment of internet

The new law has been signed by Russian president. Under new law if search engine fails to connect to the federal data bases, containing the list of web-sites which is blocked in Russia, the search engine is to be imposed a penalty. In a case of natural person the penalty is up to 5 thousands Roubles, and in a case of legal entity the penalty is up to 700 thousands Roubles.

Supreme Court made involvement of person, whose web-site can be blocked, mandatory in consideration of case

Current law provides special list of information prohibited for dissemination in Russia. If such information is disseminated through the web-site, the access to such web-site can be restricted and even if the owner or operator of such web-site is not aware thereof. So the owner or operator of web-site can face just notification that the access to his web-site is restricted in Russia. Such practice of web-sites blocking is common in Russia.

Spanski v Telewizja Polska: domestic copyright infringement from abroad

When the owner of a foreign website, acting abroad, uploads video content in which another party holds exclusive United States public performance rights under the Copyright Act and then directs the uploaded content to United States viewers upon their request, does it commit an infringing “performance” under the Act? If so, is it protected from liability by the principle – unquestioned here – that the Act has no extraterritorial application?

Experts disliked Russian RKN’s draft order on web-site identification for blocking purposes

Experts from Russian government believes Russian internet watchdog Roskomnadzor extends its authority by means of proposed draft order. They believe the draft order is to be rewritten; the draft provides Roskomnadzor with authority to restrict access to any web-site at its own discretion. But Roskomnadzor believes it has proposed the suitable draft of order – it is necessary to fix failures made by courts in their decisions and other documents made by relevant authorities or officers.

Who executes identification under proposed procedure? It is officers of Roskomnadzor. Identification is necessary in order to restrict access to certain web-site of web-page where is published information forbidden for dissemination in Russia. The Roskomnadzor is the operator of the single registry containing the URLs, domain names and network addresses of web-sites in internet where is published information forbidden for dissemination in Russia.

There will be no analogue of the Great China Firewall in Russia

The Russian ministry of communication has ensured that “the way to Great China Firewall is not for Russia”. Nobody intends to create the analogue of such “roadblocks” for global internet in Russia. As said deputy of the minister of communication, Alexey Volin, “we will never choose the Chinese way in relation to internet”.
